In a first for Nanaimo and quite possibly Canada, the city is suing its own Mayor. The city says Mayor, Bill McKay shared confidential information with administrative assistant Marilyn Smith. Smith was on medical leave from her job when she was told about a change in her job description. The city says Smith was threatening legal action over the change and the information she received from the Mayor strengthened her case and likely the undisclosed amount of settlement money she recieved from the city when they settled out of court.
The city wants the Mayor to cover the cost his alleged leak may have cost the city. According to court documents, the city alleges the Mayor breached his duty to the cityand they want a judgement for its losses or damages of settlement to Marilyn Smith and the legal fees defending her claims.
