After receiving warning letters about selling marijuana edibles, some of the Capital regions pot dispensaries are adding a little fire power of their own.
Island Health sent out letters warning shop owners they are in contravention of the BC Food Premises Regulation and that they could risk not having their licences renewed.
However, a lawyer representing several medical cannabis dispensaries, Kirk Tousaw has sent letter to Island Health declaring that the Government of Canada has approved the use of medical cannabis edibles, and that Island Health's threat to interfere with the business licensing prospects of dispensaries my cause damage to clients and patients, damages for which Island Health could be liable.
Tousaw lists two recent court victories where a ban on cannabis derivative production was ruled unconstitutional and a violation of the Canadian Charter of Rights and Freedoms.
